Requirements for domestic application of work permit for foreigners over 90 days

Under any of the following circumstances, foreigners can directly apply for work permits in China, and all application materials shall be submitted according to the Notice of Foreigner Work Permit and the Foreigner Work Permit: (1) foreign high-end talents who have entered China with other visas or valid residence certificates (Class A); (2) Foreigners working in China change employers, but the job position (occupation) remains unchanged, and the work type residence permit is within the validity period; (3) A foreign spouse or child of a Chinese citizen, or a spouse or child of a foreigner permanently residing or working in China, who holds a valid visa or a residence permit within the validity period; (4) Compliant with relevant preferential policies of free trade zones and comprehensive innovation and reform pilot zones; (5) Employers who meet the relevant preferential policies for multinational corporations' headquarters in China; (6) Personnel turnover within enterprise groups; (7) Implementing intergovernmental agreements or protocols; (8) Representative personnel of Chinese institutions who have lawfully entered China with work visas; Foreigners who have obtained a work permit to work in China for less than 90 days and are legally employed by domestic employers within the validity period of their stay in China; (9) Other approval agencies have determined that it meets the conditions.

Note: Foreigners working in China who change employers shall cancel the existing work permit in advance.

The internal mobility of personnel in the headquarters and enterprise groups of multinational corporations in China refers to the mobility of senior management personnel and professional technical personnel hired by the headquarters or enterprise groups in the same positions between the regional headquarters and its wholly-owned or joint venture subsidiaries or subsidiaries (between the parent company and its member companies or member companies) that have been registered with the licensing decision-making authority (including transferring to new positions or upgrading from professional positions to administrative management positions).

After the cancellation of the original work permit, the new work permit application shall be submitted within 30 days from the date of cancellation. The foreigner's work permit application form, employment contract (dispatch letter), valid residence permit, passport information page and cancellation certificate shall be submitted.

For job changes, relevant work qualification certificates should be supplemented and submitted.

Tips

Some visa consulting companies will provide customers with affiliated companies (third parties) on the Internet and promise to arrange work visas. It is likely that the affiliated companies will start to pay or disappear without reason on the way to apply for visas, which will affect the applicant's work visa application. Serious circumstances will also affect the applicant's visa qualification to be included in the dishonest list, leading to difficulties in accepting recent or long-term visas to China. In addition, if the company requires you to start working as soon as possible but the validity period of your visa is not sufficient to obtain documents such as a certificate of no criminal record and academic certification, you can apply for an A-class talent work permit according to your personal situation to quickly join the company.
